Sean ‘Diddy’ Comb’s request to dismiss male producer’s ‘Sex Trial’ denied

Sean ‘Diddy’ Combs could be back in court soon, RadarOnline.com can report, after the rapper’s desperate attempt to dismiss a new sexual assault charge was dismissed “in its entirety.”

That paves the way for a lawsuit against music producer Jonathan Hay, who has accused Combs of sexually assaulting him multiple times.

In documents obtained by RadarCombs had filed for Demurrer – with Motion to Strike in the lawsuit, on the grounds that Hay “failed to state facts sufficient to give rise to action and uncertainty.”

However, in a detailed decision, Judge Michael E. Whitaker denied each request, ruling: “The Court denies the Combs Defendants’ motion to strike in its entirety. Further, the Court denies the Combs Defendants’ motion to strike in its entirety.”

Hay came forward late last year and revealed that he is the “John Doe” who charged Combs shortly after his historic rape and prostitution trial concluded.

In an exclusive interview with RadarHay claimed he suffered a handful of disturbing incidents with Combs, including the forced performance of “oral s–” on the musician.

“I can’t put into words how disturbing that incident with Sean Combs was on so many levels,” Hay said. “As a man, being so violently violated and humiliated is something I will never get over. The thoughts keep repeating themselves. I cannot escape them.”

If Radar Previously reported, Hay first met Combs sometime around 1998 while working on a project together. Years later, Hay would be invited to a meeting with the I will miss you hitmaker again for a possible collaboration, but that’s where he claims things got ugly.

According to his lawsuit, Combs turned to the plaintiff and asked if he was looking at defendant Combs’ genitals. Caught off guard, the plaintiff denied it and laughed, trying to ignore the bizarre comment.

“Defendant Combs continued to dance and repeated the accusation, claiming that Plaintiff wanted to see his genitals. Then Defendant Combs stepped closer and pulled down his pants, exposing his pants.” [expletive]and told the plaintiff to look at it as he was “trying to look.”

Combs allegedly came closer and told the other man to “touch” his [expletive]. When he tried to turn away, Combs reportedly became physical.

“Plaintiff attempted to replay it with nervous laughter, turning his chair away from Defendant Combs in an attempt to create distance,” the lawsuit reads. “But Defendant Combs continued, pushing himself toward the plaintiff’s face and telling him to suck it.”

The alleged attack was only stopped when a loud buzz interrupted the moment, causing Combs to leave.

Hay also claims he was in the room when the now-jailed music mogul allegedly masturbated into the shirt of the late Biggie Smalls, who then splashed him with s—-.

According to the legal documents, Combs allegedly grabbed a shirt belonging to the late rapper and had an orgasm in the garment. He then threw it at Hay, before saying: “RIP Biggie.”

Combs is currently serving a 50-month prison sentence at Fort Dix Federal Correctional Institution in New Jersey after being convicted in July 2025 of two counts of transportation for prostitution.

He was recently released early after being accepted into a substance abuse rehabilitation program and is expected to be released on April 25, 2028.
