According to the complaint Placed in the Superior Court of California for Los Angeles County, obtained by People Magazine, Devyn Labella claimed that she was “the victim of a violent, unwritten, unplanned rape scene directed by Kevin Costner” on the set of Horizon: An American Saga – Chapter 2.
The production companies involved in the film were also mentioned in the court case.
Labella asked for a test jury and the amount for which she suits is not revealed.
Labella was hired to be the stunt doubles for the main actress of the film, Ella Hunt, and her task was to get up for Hunt ‘during physical scenes’.
According to the complaint, SAG does not “suffer from last-minute requests for nakedness or simulated sex”, and a 48-hour notification is required to get the consent of the contractor for updates with regard to intimate scenes.
Hunt’s contract also required a ‘coordinator for all intimacy scenes’.
According to the submission, Labella was on 2 May 2023 on the set for a “non-intimate scene” as Hunt’s stunt doubles when the Yellowstone The actor would have added a scene in which a second actor Roger Ivens was involved, and he instructed him to “climb on top of Mrs. Hunt, violently picking up her skirt.”
Labella also claimed in the submission of the protagonist that set ran after he reportedly refused to film the scene.
On the set, Costner is said to have requested Labella to be responsible for the main actress “without the correct notification, permission, preparation or suitable guarantees measures”.
She also claimed that the added scene for that day was not mentioned on the call -sheet – and she ‘never gave permission’.
After filming the scene, Labella claimed in the court case that she experienced “memories of shame, humiliation and complete lack of control” and took a few days off from the set.
When she returned, Labella claimed that the environment was ‘uncomfortable’, and others would reported ‘apologies’ for Costner.
After the alleged incident, Labella said that she was left with “permanent trauma” that influenced her career.
She started with therapy in June 2023 after reporting ‘sleep disorders, fear of intimacy and fear’.
In a statement to the magazine, Labella said: “On that day I was uncovered, unprotected and deeply betrayed by a system that promised safety and professionalism. What happened to me, shattered my confidence and changed forever how I went through this industry.
“While I keep performing and in my journey of stunt coordination step, I operate with a fierce commitment to maintain the highest standards, create sets where safety, communication and permission are non-negotiable.
“This experience has inflamed a lifelong mission in me to be the lawyer I once needed, to ensure that no one else is ever left as vulnerable as I was.”
In a statement to the magazine, Costner’s lawyer Marty Singer denied the allegations and claimed that the actor “always wants to ensure that everyone works comfortably on his films and takes the safety on the set very seriously.”
He claimed that Labella is a “serial prosecutor” and her allegations are “completely contradicted by her own actions – and the facts”.
Singer claimed that Labella approved the scene after it was rehearsed and even gave her stunt coordinator a “thumb up”.
