Estimated damage in the Batton Commission trial is more than $ 10 billion

The latest files in the court case include the testimony of expert Witness Norman Miller. In his statement, Miller claims that the rates of the buyers’ broker committee showed extreme price stiffness, around the same increased rates, despite inflation and changes in technology that have increased the efficiency and regardless of the experience of the agent, the hours worked or the tasks performed. “
Moreover, Miller’s statement claims that the rules of NAR, including the now -defined participation rule ‘stimulation[ed] Agents to ‘send’ buyers to certain houses based on the committee rate of the house. ”
Compare committees of foreign markets
The archives also estimate compensation in the court case. To do this, they were looking for the help of Rose M. Abrantes-Metz, an expert witnessed who examined transactions in four of the 39 mlss, including Triad MLS In North Carolina, Stellar MLS In Florida, Southwest MLS In New Mexico and South-Central Kansas MLS In Kansas.
In its report, Abrantes-Metz compared the committees that buyers paid to their agents with the copy of the buyer in comparable foreign markets. According to her analysis, Abrantes -Metz found the average agent commission of these foreign markets 1.38%, much lower than the “typical” 3% rate in the US.
Based on this, Abrantes-Metz estimates that buyers in the proposed class would have the right to $ 8,524 compensation each because of the supposed committees and house prices. For the four MLSs this would be a compensation of $ 3.6 billion. This is expected to be in the dozens of billions of dollars balloon for the entire proposed class.
Abrantes-Metz, however, noted that the proposed class could be reduced by around 75% as a rules of a professional court that reached settlements in the lawsuits of the Home Seller Committee Dekbuyers who also sold houses during the overlapping proposed class periods. Her calculations show that at least 24% to 28% did not sell the proposed class during the Batton class period. Yet this estimated damage is much higher than the $ 1.78 billion in compensation awarded in the court case of Sitzer/Burnett Home Seller Commission.
In general, the class proposed by the plaintiffs all the buyers who have paid a buyer-broker commission when purchasing a property in 39 mlss between 25 January 2015 and 31 December 2021, but the exact period of time varies depending on the antitrust and consumer protection laws of each state.
In total, the proposed class would include millions of buyers in 23 states and Washington, DC
In an e -mail statement, a spokesperson for Nar wrote that the trade group is dedicated to promoting a “competitive, honest and transparent real estate market, which means that buyers and sellers are authorized to fully negotiate compensation with their agent and gain access to the many benefits that professional representation offers.”
“We will continue to argue for our position as the case progresses,” the spokesperson added.
