Diddy Judge orders prosecution to destroy notes obtained during raid
The Fed raid has begun DiddyThe rapper’s jail cell has proven to be inconsequential for now, as a judge sided with the rapper’s defense after hearing arguments from both sides.
A search hearing was held at MDC Brooklyn on Tuesday after Diddy’s defense team accused prosecutors of obtaining privileged material in an unlawful raid on the rap mogul’s jail cell.
While the prosecutor denied deliberately seizing 19 pages of legal notes, the judge ruled Arun Subramanian ruled that they must destroy copies of the papers obtained in the search – and said they could not consult the materials until he made a final decision on whether they could be used in the trial.
He ordered the prosecutors… “Get rid of them.”
The Public Prosecution Service has previously defended the raid was justified because Diddy allegedly tried to influence witnesses and potential jurors with his antics behind bars. Still, the Bad Boy Records founder’s attorney argued the search violated many of the star’s rights.
The defense also accused the Fed of seizing privileged attorney-client material related to Diddy’s sex trafficking/racketeering trial… but the prosecution defended that most of the material was personal to the music mogul.
This is just the latest update in what is sure to be a lengthy legal saga for Diddy… whose trial is set to start on May 5.
As TMZ previously reported, Diddy was arrested and charged in September. charged with racketeering conspiracy, sex trafficking and transportation to engage in prostitution. The rapper pleaded not guilty on the charges…trying and failing twice to get bail. His third bail hearing is scheduled for November 22.
Diddy is also facing a number of lawsuits, accusing the star of various misdeeds… including rape, physical and sexual abuse, and human trafficking.
He has denied all allegations against him.
