Diddy prosecutors say no trial strategy documents were seized during a raid
Diddy tried to influence witnesses and the future jury of his colleagues while behind bars, according to prosecutors who filed legal documents in an attempt to justify the raid on his jail cell.
As we reported, the FBI raided Diddy’s cell late last month and according to Diddy’s lawyer… Marc Agnifiloseized attorney-client privileged material from his cell and turned it over to prosecutors.
The U.S. Attorney’s Office disagrees, and in new documents obtained by TMZ, Diddy used illicit communication methods to reach third parties through three-way calls on monitored phone lines, using other inmates’ phone passcodes and using a third-party texting provider . In short, prosecutors say Diddy tried to rig his trial.
According to the new documents, Diddy had files on his bed: a folder marked “legal,” a notebook, an address book and personal belongings.
Prosecutors dispute Agnifilo’s version, saying they did not seize the legal folder. They felt it from the outside to determine if there was any contraband, and not noticing anything, they set it aside, did not open it or photograph it.
As for the notebook and address book, the jail official took pictures of the items and left them on Diddy’s bed. According to the U.S. Attorney’s Office, no physical materials were seized.
Prosecutors say they turned the photos over to a “filter team” to determine if there was anything privileged that should remain private. The filter team redacted anything that appeared privileged and then turned over the redacted photos to prosecutors.
The U.S. attorney says the photos contained “extensive notes to himself, including notes regarding [Diddy’s] business interests, his music release and family matters.”
In addition, the US Attorney’s Office says the raid was planned well before Diddy’s arrest and was not intended to attack Diddy or any other specific inmate. They say this was to ensure the safety of staff and prisoners.
Agnifilo is confident that the FBI is now in possession of documents that reveal the trial strategy. Plaintiffs clearly disagree with this accusation.
Diddy’s lawyer demanded a hearing to find out exactly what happened during and after the raid.
