Realty ONE Group requests dismissal from Masiello’s commission case

The Masiello copycat commission lawsuit plaintiff and Realty ONE Group Arizona have filed a joint motion to dismiss the brokerage defendant from the lawsuit with prejudice. The motion was filed Thursday in U.S. District Court in Phoenix.

According to the motion, the desire to dismiss the lawsuit stems from Realty ONE Group’s settlement in the Gibson lawsuit, which was finalized in late October.

Due to the approval of the settlement, the parties assert that “there are no actionable claims pending against Realty One Group Arizona in this matter, and therefore, Realty One Group Arizona should be dismissed with prejudice from this action.”

The Masiello case, originally filed in early January 2024, was one of about two dozen lawsuits against copycat commissions filed in the months following the jury’s verdict in the Sitzer/Burnett lawsuit.

The defendants initially named in the lawsuit include Arizona Association of Realtors, Phoenix Association of Realtors, Scottsdale Area Association of RealtorsAnd Western and Southeastern Realtors of the Valley Incorporated. In addition, there are several local and national brokerage firms, including HomeSmart, My home group, Western US real estate, Hague Partners Holdings, Real estate managers, Best Real Estate in Arizona, North & Co., Zilverblad Real Estate, Walt Danley Local luxury, Christie’s International Real Estate, The real estate agency, Roy H Long Realty Co. And Tierra Antigua Real Estate.

Realty ONE Group announced the proposed settlement in April 2024.
